SpicyChat Age Verification: Is SpicyChat Safe in 26 States

SpicyChat requires age verification in 26 US states and in the United Kingdom, France, Italy and Australia, and the requirement is applied by IP address rather than by account. The default check is a video selfie that a third party estimates your age from, with a government ID upload as the fallback when the selfie is inconclusive. Declining does not lock you out of the platform: you keep your account, your chats and your characters, and you keep safe for work content. What you lose is the adult content the site is built around.

That makes SpicyChat one of the most heavily age gated services in this category, which is strange given that it is also one of the least regulated in terms of distribution. It has been removed from the Apple App Store, its Android app is a direct APK download rather than a Google Play listing, and four separate apps trading on its name sit in the App Store today, none of them published by the company that runs SpicyChat. Does SpicyChat require age verification?

Yes, but only if you are in a jurisdiction that compels it. SpicyChat starts every account with a self declared date of birth, which is the same weak first check almost every companion app uses. On top of that it applies a real age assurance step for users whose IP address places them in a covered region, and it does so specifically to satisfy laws that came into force across 2025 and 2026.

This is the pattern worth understanding before you judge any app by its age gate. Very few platforms in this category verify age because they decided to. They verify where a government made them, and the map of who checks what is really a map of legislation rather than a map of corporate care. SpicyChat happens to sell explicit content to a US audience from a company with a US entity, which puts it squarely in the path of the state laws that followed the Supreme Court's 2025 decision upholding Texas age verification for adult sites.

Which US states require SpicyChat age verification?

As of August 2026, a public tracker of the platform's rollout lists 26 states where the check is enforced, with West Virginia the most recent addition in June 2026. Alongside them sit four national requirements.

The list is not stable and it is not meant to be. More than a dozen further states have age verification bills either in committee or awaiting a signature, so a reader in an uncovered state today should assume the question is when rather than whether. For a company selling into all of this, the actual operating problem is keeping track of which of fifty states plus four countries currently demands what, and proving it applied the right rule to the right visitor. That is now a standing cost of doing business online, and it is why so many operators have started to map each new obligation to the control that satisfies it rather than reacting law by law.

What does the SpicyChat age check actually involve?

Two methods, in order. The default is a video selfie: you record a short clip and a third party age assurance provider uses facial analysis to estimate whether you are over 18. No document is involved and nothing is compared against a government database. The fallback, used when the selfie is inconclusive or fails, is a manual check against a government issued ID.

The distinction matters more than most people realise. Facial age estimation from a selfie is the lighter of the two: the provider is guessing an age band from your face rather than reading your name, address and document number. An ID upload hands over a full identity document, and that document sits with the verification vendor rather than with SpicyChat. If you are weighing the privacy cost, the question to ask is not whether the platform is trustworthy but which vendor is holding the artefact, how long they keep it, and what happens if they are breached. Age verification vendors have already had their own security incidents, and a leaked estimation selfie and a leaked passport scan are very different problems.

What happens if you refuse to verify your age on SpicyChat?

You keep the account and lose the content. Users who decline verification retain access to the platform and to safe for work material, while unrestricted content stays locked until the check is completed. Your account data, conversation history and character library are not deleted and are waiting for you if you verify later.

That is a softer failure state than a hard block, and it is worth knowing before you assume a paid subscription would be wasted. Is SpicyChat safe to use?

On the measures that can be checked rather than argued about, it is mid table, with one genuine strength and one real gap. The strength is corporate transparency. SpicyChat's footer names its operator on every page: NextDay AI Incorporated in Montreal, NextDay AI USA Inc registered in Delaware, and NextDay AI EU Ltd in Limassol, Cyprus. Several competitors publish no corporate identity whatsoever. It also publishes an 18 U.S.C. 2257 record keeping compliance statement, the US federal requirement for producers of sexually explicit material, plus separate terms, privacy, refund and reporting pages and a public security and vulnerability disclosure policy. That is a company behaving as though regulators exist.

The gap is that almost none of its disclosures are enforced by anyone. Because SpicyChat is in neither app store, it publishes no Apple content advisories and no Google Play data safety declaration under its own name. The one enforced disclosure NextDay AI makes anywhere is for PixelChat, its safe for work sibling app, which is live on Google Play. That declaration reports that device or other identifiers are shared with other companies for analytics and for advertising or marketing, and that app interactions, purchase history, name and email address are collected, with app interactions also used for advertising or marketing. Data is encrypted in transit and deletion can be requested.

Read plainly, that is a lighter privacy footprint than some rivals and a heavier one than others. Why is SpicyChat not on the App Store or Google Play?

Because it was removed from both, and its own documentation says so without much dressing up. SpicyChat states that it does not have a native iOS app on the Apple App Store, and tells anyone who installed it before its removal that they may keep using that build, though it is no longer updated and offers a degraded experience. For iPhone the recommended route is adding the website to the home screen. On Android the official app is an APK downloaded directly from spicychat.ai, and the documentation is explicit that it is not available on the Google Play Store. Checking Play confirms it: the package NextDay AI used for SpicyChat returns a 404.

This creates a problem the company did not cause but has not solved either. With no official listing, the App Store search results for SpicyChat are filled by other developers trading on the name. Every app below was returned by Apple's own software catalogue on 5 September 2026, and not one of them is published by NextDay AI.

If you searched the App Store for SpicyChat, downloaded the top result and entered a card, you would be subscribing to a company in Chengdu or a Greek single member company rather than to the platform you were looking for. That is the practical safety issue here, and it is a bigger one for most people than anything in SpicyChat's privacy policy. There is one legitimate store route: NextDay AI's safe for work app PixelChat is on Google Play, and SpicyChat's documentation states that a PixelChat subscription applies to SpicyChat as well.

How SpicyChat's age gate compares with the rest of the category

Set against its peers, SpicyChat runs one of the strictest age checks in the category while operating with the least store level oversight. That inversion is the interesting part. SpicyChat is outside both stores too, and yet it runs the widest geographic age gate of any of them. The reason is that its exposure is not to Apple or Google but to state attorneys general and to four national regulators, and those are harder to route around than a store policy. An app that gets pulled from a store loses distribution. A company that ignores a state age verification statute faces damages. So the platform with the weakest distribution ends up with the strongest identity check, which is exactly backwards from what most buyers assume when they judge safety by whether something is in the App Store.

The short verdict

SpicyChat's age verification is real, it is expanding, and if you live in one of those 26 states you will be asked for a video selfie of your face before you can see the content you came for. That is not a reason to avoid the platform. It is a reason to decide, before you pay anything, whether you are willing to hand a face scan to a third party vendor for a roleplay library, and to verify first so you are not paying for content you cannot reach.

The genuinely useful conclusion is a narrower one. An age gate tells you about the law where you live, not about how carefully a company treats your data, and the two are almost unrelated. SpicyChat names its corporate entities, publishes a 2257 statement and runs a vulnerability disclosure process, all of which are better signals than the strictness of its age check.
